A Midland woman told an Isabella County judge that she woke up in a casino hotel room to her ex-boyfriend having sex with her and that when she told him to stop that he told her to wait until he was finished.
Logan Alexander Eilts, the 20-year-old ex-boyfriend in question, was formally bound over for trial on two counts of third-degree criminal sexual conduct — one count based on coercion or force — during a hearing Thursday.
Eilts was originally charged with one count, but Isabella County Prosecutor Dave Barberi asked for the second count after testimony from the 17-year-old woman Eilts is accused of raping in the early hours of Nov. 10, 2021.
The two went to a room in the Soaring Eagle Casino & Resort to hang out. She said Eilts and a friend of his smoked marijuana from a bowl earlier in the evening. A police report about the incident said that Eilts was drinking, but the woman said there was no alcohol involved.
They had previously had a relationship of some kind that involved consensual sex. The woman said the relationship had ended well before, but later told Eilts’ attorney, Dominic Greco, they’d had sex in September.
The woman said they watched Tee Vee until approximately midnight when she went to bed. It took her some time to fall asleep, with another man in the next bed over, but after she did she was awakened shortly after with Eilts on top of her.
“I told him to stop and get off,” she said, adding that she said he said he wanted to finish.
Afterward, she told Circuit Court Judge Sara Spencer-Noggle that she went to the bathroom for approximately 10 minutes and tried to get in contact with family or friends to discuss what had just happened.
One of her friends responded and the woman said she went to the casino lobby.
Greco asked her anyone saw them walking around arm-in-arm in the lobby, adding that he could get footage from the lobby cameras.
The woman said that her friend showed up at approximately 12:30 p.m. later that day with officers from the tribal police.
Once she was finished testifying, Barberi asked the judge to amend his criminal complaint to include the second count of third-degree CSC.
Spencer-Noggle allowed him and bound Eilts over for trial.
