Man gets jail in casino sexual assault case – The Morning Sun

A Gratiot County man who has been in the Isabella County Jail will spend approximately 20 more days lodged as part of a plea deal to dispose of a rape accusation.

Logan Alexander Eilts, 20, pleaded guilty to aggravated assault, a misdemeanor, after originally being charged with third-degree criminal sexual conduct, a 15-year felony, last November.

Eilts was accused of raping an ex-girlfriend while she slept in a bed at Soaring Eagle Casino & Resort. During his sentencing, Isabella County Prosecutor Dave Barberi told Circuit Court Judge Mark Duthie that new information came to light after Eilt’s Jan. 9 preliminary hearing that warranted the deal.

A preliminary hearing is used to determine whether sufficient evidence exists to put a defendant on trial.

Duthie sentenced Eilts to 135 days in jail, Eilts has been in the Isabella County Jail since his early November arrest and received 100 days credit. With five days shaved off a sentence for every month of good behavior, Duthie told Eilts that he’s in “good shape” on his jail time.

Eilts was also sentenced to 18 months of probation.

Eilts, an ex-girlfriend and another friend were staying in a room at the Soaring Eagle Casino & Resort on Nov. 10. Eilts and the woman slept in one bed and the friend slept in the other. The woman accused Eilts of having sex with her body after she fell asleep, and refusing to stop immediately when told.

The woman texted a friend and they met with an officer from the Saginaw Chippewa Indian Tribal Police the next day, and the officer found Eilts sitting outside the casino early in the afternoon.

Eilts told the officer that the two had sex, but that he believed that it was consensual, a police report about the incident said.
