The fight over the Lago Resort & Casino in Seneca County is not over, yet.

Casino Free Tyre, which opposes the 207-room hotel and casino being built in the town of Tyre, vowed to appeal a state supreme court justice's ruling that found the town acted legally in deciding that the resort would not have a negative impact on the community.

"Although we are disappointed with the decision, all of the parties have known that there would be an appeal, regardless of the outcome. We are hopeful that the appellate court will overturn this again, just as it did the last time this case was appealed," the anti-casino group said in a statement.

This is the second time Tyre officials have found that the casino that promises to have 1,800 permanent jobs would not have a negative impact on the community following a state required review.

Following an appeal by Casino Free Tyre, the appellate court ruled that the town needed to perform another review. Officials performed another review and on Oct. 1, again found that the casino would not have an impact.

This is not the only legal challenge facing the resort and casino. The Oneida Indian Nation has filed suit against the New York State Gaming Commission alleging that the commission was subjective in granting Lago Co-Chairman Thomas Wilmot Sr. a gaming license for the project.
