Judge: Tyson can't intervene in Ala. casino suit - BusinessWeek

A federal judge has turned down a request by the governor's gambling task force to intervene in a lawsuit against VictoryLand owner Milton McGregor.

Task force Commander John Tyson had wanted to intervene in a suit where charities hoping to develop a second

casino in Macon County are suing McGregor and Macon County Sheriff David Warren. If he was able to intervene, Tyson would have gained access to sealed records in the litigation.

U.S. District Judge Keith Watkins on Sept. 30 denied Tyson's request. The judge said the lawsuit does not involve the legality of electronic bingo and any information obtained from intervention would be too tangential to Tyson's primary interests.

The judge also noted that some of the records sought by Tyson have now been made public.
