Rivers Casino is one of the newer facilities in Pennsylvania, and on Wednesday the casino learned that it is the subject of a lawsuit. A security guard has filed a lawsuit claiming the casino did not pay her for overtime that she worked.
Pauline Schaefers filed the lawsuit on behalf of herself and other security guards. Schaefers contends that Rivers Casino did not pay the guards properly before the employee time clocks were installed. The casino, by law, must pay any employees that work over forty hours time and a half.
The lawyer representing Schaefers want a judge to approve a class action lawsuit. If approved, thirty guards in all would be part of the legal proceedings. Schaefers has been working at the casino since last year, before the casino was even open to the public.
Schaefers not only contends that the casino did not pay the security guards the time and a half that is mandated by law, but claims they did not pay the employees for any work done above the forty hours. The casino has not yet responded because they have not been served with the lawsuit.
Rivers Casino is an integral part to the Pennsylvania casino industry. The casinos have been attracting customers not only from their own state, but also from New Jersey. Gamblers in New Jersey are choosing the newer facilities in Pennsylvania over the old casinos in Atlantic City.
The Fair Labor Standards Act is in place to protect workers from putting in extra hours over a normal work week. The overtime pay of time and a half was put in place to keep employers from overworking their employees, but many businesses throughout the US have employees working fifty or sixty hours a week and only getting paid for forty hours.
